ACKNOWLEDGMENT OF RISK AND LIMITATION OF LIABILITY

PLEASE READ CAREFULLY BEFORE SIGNING.

This Agreement is entered into by and between Pursuit Performance, its coaches, directors, employees and affiliates (collectively, the "Company"), and the undersigned client (the "Client").

1. Acknowledgment of Inherent Risks

I understand that participating in endurance training programs (including, but not limited to, running, cycling, swimming, triathlon, strength training, and related activities) provided by the Company involves inherent risks, dangers, and hazards. These risks include, but are not limited to, muscular injuries, sprains, fractures, cardiovascular events, environmental hazards (such as traffic, weather, and terrain), and serious personal injury or death. I acknowledge that I am participating in these activities voluntarily and fully understand the natural risks involved in endurance sports.

2. Medical Clearance & Health Status

I confirm that I am in good physical condition and know of no medical, physical, or mental reasons why I should not participate in an endurance training program. I acknowledge that the Company srecommends I consult with a General Practitioner (GP) or relevant medical professional before beginning any new exercise or training programme.

3. Remote and Online Coaching Acknowledgment

I understand that the Company provides online and remote coaching. Because the coaches are not physically present during my workouts, I acknowledge that I am solely responsible for my own physical safety, maintaining proper form and technique, navigating safe routes, and monitoring my exertion levels and physical symptoms during all training sessions.

4. Limitation of Liability

Nothing in this Agreement shall limit or exclude the Company's liability for:

Death or personal injury caused by its negligence, or the negligence of its employees, agents, or subcontractors;
Fraud or fraudulent misrepresentation; or
Any other liability which cannot be limited or excluded by applicable law.

Subject to the above, the Company shall not be liable to the Client, whether in contract, tort (including negligence), for breach of statutory duty, or otherwise, arising under or in connection with this Agreement for:

Loss of or damage to personal property or equipment;
Any indirect or consequential loss; or
Injuries or damages resulting from the Client's failure to follow instructions, the Client's own negligence, or the inherent, natural risks of participating in endurance sports.

5. Governing Law and Jurisdiction

This Agreement, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with the laws of England and Wales. Both parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement. (Note: Change to Scotland or Northern Ireland if your business is based there).

CLIENT ACKNOWLEDGMENT

By signing the digital consent box, I acknowledge that I have carefully read this Acknowledgment of Risk and Limitation of Liability and fully understand its terms. I agree to comply with the terms set out above and accept responsibility for my own safety during my training.
